WeVaad is pleased to announce the release of the second edition of the WeVaad Newsletter, continuing our mission to build awareness and foster dialogue around Online Dispute Resolution (ODR) and Mediation in India.

As an independent ODR institution, WeVaad provides a time-bound, cost-effective, and confidential alternative to traditional litigation through institutional e-mediation, e-arbitration, and e-conciliation.

This edition features an insightful article titled “Refusing Mediation Should Come at a Cost,” authored by Prashant Narang, Deputy Director, Research and Programs, TrustBridge Rule of Law Foundation, Delhi, and Kritika Sethi, Co-Founder and Mentor, WeVaad. The article was originally published on Moneycontrol.

In light of the Hon’ble Chief Justice of India, Hon’ble Shri Justice B.R. Gavai’s “Mediation for the Nation” campaign, the article proposes practical steps to strengthen the culture of mediation in India.

It poses an important question:

Is mediation truly effective, or has it become a mere legal formality? 

While mediation exists on paper, it is often overlooked in practice. Courts remain burdened, voluntary attempts frequently fail, and refusal to mediate rarely attracts any consequence.

This matters because weak penalties and the absence of incentives make it almost cost-free to skip mediation. Introducing credible penalties, early cost assessments, and behavioural nudges could transform mediation into a truly effective and result-oriented mechanism.

The article emphasizes that these measures can help reduce judicial backlog and promote a more robust culture of dispute resolution across India.
