Arbitration

Arbitration is a procedure of dispute resolution between the parties which is governed by the Arbitration and Conciliation Act, 1996.  Its features are as follows:

  • Parties are free to choose the arbitral tribunal and procedure to govern the arbitration;
  • Limited court interference;
  • Time bound process;
  • Confidential;
  • Minimizes cost; and
  • Speedier resolution.

Mediation

Mediation is a procedure of dispute resolution between the parties which helps the disputing parties reach a settlement of their disputes.  Its features are as follows:

  • Informal procedure;
  • Confidential;
  • Parties are able to strengthen their relations;
  • Minimizes costs; and
  • Speedier resolution.

Conciliation

Conciliation is a procedure of dispute resolution between the parties, governed by the Arbitation and Conciliation Act, 1996, which helps the disputing parties reach a settlement of their disputes.  Its features are as follows:

  • Informal procedure;
  • Confidential;
  • Parties are able to strengthen their relations;
  • Minimizes costs;
  • Speedier resolution;
  • Settlement agreement is enforceable as an arbitral award.
